Karenanya, tidak seorangpun yang dapat mengabaikan, termasuk negara ataupun penguasa atau pemerintah. Atas dasar itu, negara dan pemerintah harus menghormati, menghargai, menegakkan, dan melindungi HAM. Secara konseptual negara yang diharapkan dapat mewujudkan itu semua hanyalah Negara Hukum yang menganut paham demokrasi yaitu Negara Hukum Demokrasi (Democratiche Rechtsstaat).
