Public Management Reforms Between Austerity and Democracy

This book deals with the critical empirical void created by the speed at which healthcare restructuring has taken place in Europe. Chapters explore the political uncertainty and budgetary pressures which have led governments increasingly to turn to New Public Management (NPM)-style reforms to attempt to balance the financial viability of public health structures, with democratic imperatives to maintain socially just outcomes. The authors of this volume consider how governments have therefore shifted identities from principal care providers to contractual monitors, setting targets increasingly directed toward third-party managers in quasi-markets and the private sector. Drawing upon extensive data from Germany, Norway, the Netherlands, and Israel, the contributions explore the often unexpected policy outputs and outcomes engendered by such reforms.

Public Policy and Performance Management in Democratic Systems

Theory and Practice

This book applies various theoretical tools to explore the advantages and disadvantages of performance management systems, the ways in which they can be improved, and the strategies through which they can be designed and integrated into the policy making process. By providing both theoretical insights and practical applications, it offers a unique perspective. Using four methods of research that have been rarely applied in the performance management literature: formal (game-theoretical) modelling, operational management, new institutionalism, and cross country statistical comparisons based on international data sets, the book illuminates different aspects of performance management systems in the public sector. This book addresses current practices in customary law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada etc.), who examine the current impacts of customary law on various aspects of private law, constitutional law, business law, international law and criminal law. In addition, the book expands the traditional concept of the rule of law, and argues that lawyers should not narrowly focus on statutory law, but should instead pay more attention to the impact of practices on “real legal life.” It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems – the idea being not to replace statutory law, but to complement it with customary observations.
